 MAJOR RISKS I.A.L

Since June 1st, 2006, requirements apply as regards to information about lessor-tenant risks (I.A.L.) during any real estate transaction.
This new law is based on double liability and is applicable to anyone saling or renting ( even for a short period of time) a property (build or not) :
a) to inform buyers or tenants about the location of the property with regard to earthquake zones and/or about a Risk Prevention Plan (RPP)
b) to inform buyers or tenants about any casualty compensation following an act of God or man-made disaster recognized as such.
The I.A.L.’s goal is to allow the buyer or the tenant to be aware of constraints related to the premises he will occupy, casualties incured, and liability and recommandations to be respected for his own security.
This measure results from the law dated 30 July 2003, relating to man-made risks and act of God prevention, and damage mending.
The lessor must provide and append to the rental contract :
- a statement on plain paper relating any casualty incured since 1982 subjected to a compensation following any disaster recognized as such.
- a current statement relating acts of God and man-made risks (E.R.N.T) (less than 6 months old), including information provided by the department’s prefect, and established as a public document.
This statement on plain paper and the E.R.N.T. must be signed by the owner lessor.
The I.A.L. aims at introducing acts of God and/or man-made risks into our culture and daily life.
Information is the first prevention step.
